City Beach is facing legal action over claims that they sold 'extremely hazardous' kids' toys with non-conforming button batteries.
From June 2022 to October 2024, the retail company faced allegations for offering 70 different product lines that failed to meet Australia’s safety requirements for button batteries.
Fewstone Pty Ltd, operating under the name City Beach, allegedly provided 57,358 individual non-conforming button battery items, according to claims made by the Australian Competition and Consumer Commission (ACCC).
The items reportedly consist of novelty products like toys, digital notepads, keychains, lights, and Crocs Jibbitz accessories.
"We are implementing this measure due to our allegations that City Beach [reportedly] put consumers at risk from button battery hazards without properly informing them," stated ACCC Deputy Chair Catriona Lowe.
'Batteries of the button type pose significant risks to small children, and unfortunately, they have resulted in severe harm or even fatalities in certain instances where they were swallowed, inserted, or consumed.'
Lowe mentioned that the ACCC was worried about young children receiving non-compliant items since many of these products were brightly colored or featured lights.
The regulatory body stated that items needed to comply with safety regulations to guarantee kids couldn’t reach the 'hazardous' battery sections.
Previously, in both 2022 and 2023, City Beach was issued warnings by the authorities of New South Wales and Queensland for not adhering to these lifesaving regulations.
To ensure compliance, businesses need to test a representative selection of products that include button batteries.
Product safety warnings should likewise include guidance on when to seek medical help.
This marks the first instance where the ACCC has taken a case to the Federal Court due to alleged violations of the button battery standards.
The surf and skate store is initiating a voluntary recall, allowing customers to bring back affected items for a complete reimbursement.
